Abstract
Дисертація на здобуття наукового ступеня доктора філософії за спеціальністю 081 «Право». – Національний технічний університет «Дніпровська політехніка», Дніпро, 2025. Дисертація є одним із перших комплексних наукових досліджень, присвячених здійсненню характеристики суб’єктивних публічних виборчих прав та суб’єктивних публічних управлінських прав приватної особи. У результаті дослідження сформульовано низку нових наукових положень, рекомендацій і висновків, зокрема: вперше: - обґрунтовано, що до системи форм реалізації суб’єктивних публічних управлінських прав та суб’єктивних публічних виборчих прав відносяться : виконання, використання, дотримання, застосування, які у складній сукупності впроваджуються в окремих способах, що залежать в конкретних історичних, економічних, соціальних характеристик розвитку держави та суспільства; - пропозиції щодо внесення змін до Виборчого кодексу України, Кодексу адміністративного судочинства України, Закону України «Про звернення громадян» задля забезпечення ефективності реалізації та захисту суб’єктивних публічних управлінських прав та суб’єктивних публічних виборчих прав.
Dissertation for the Doctor of Philosophy degree in specialty 081 «Law». - Dnipro University of Technology, Dnipro, 2025. The dissertation is one of the first complex scientific studies devoted to the characterization of subjective public voting rights and subjective public management rights of a private person. As a result of the research, a number of new scientific provisions, recommendations and conclusions were formulated, in particular: - it is substantiated that in the system of forms of realization of subjective public administrative rights and subjective public electoral rights are: implementation, use, observance, application, which in a complex aggregate are implemented in separate ways, depending on specific historical, economic, social characteristics development of the state and society; - proposals for amendments to the Election Code of Ukraine, the Code of Administrative Procedure of Ukraine, the Law of Ukraine «On Appeals of Citizens» in order to ensure the effectiveness of the implementation and protection of subjective public administrative rights and subjective public electoral rights.
