Право людини на судовий захист : публічноуправлінський аспект

Abstract

Дисертація на здобуття наукового ступеня доктора філософії в галузі публічного управління та адміністрування за спеціальністю 281 – «Публічне управління та адміністрування» – Національний технічний університет «Дніпровська політехніка», Дніпро, 2023. Дисертація присвячена дослідженню теоретико-методологічних засад, тенденцій розвитку та особливостей публічноуправлінської діяльності в забезпеченні права людини на судовий захист. У дисертації досліджено інституціональні й теоретичні засади трансформаційного процесу в публічному управлінні щодо ролі органів системи правосуддя в забезпеченні права на судовий захист. Визначено підходи до формування системи правосуддя в контексті суспільного змісту публічного управління, розкрито сучасний стан та особливості нормативно-правового забезпечення публічноуправлінської діяльності в системі органів правосуддя, організаційно-правового спрямування модернізації державного механізму правозахисту як напряму державноуправлінських трансформацій. На цій основі удосконалено напрями й перспективи впровадження європейського й національного досвіду у сфері захисту прав людини в практику публічного управління в Україні й на підставі цього встановлено напрями та інституціональні форми функціонування спеціальних механізмів публічного управління у сфері судового захисту прав людини, а також розмежовано поняття «органи правосуддя», «органи судової влади» та «судові органи» з позицій концепту правозахисту, наведено авторську редакцію таких понять як «публічна судова послуга», «декомпозиція права на судовий захист», що розроблені на основі аналізу національного досвіду модернізації публічного управління. The dissertation is devoted to the study of theoretical and methodological foundations, development trends and features of public administration activities in ensuring the human right to judicial protection. The dissertation examines the institutional and theoretical foundations of the transformational process in public administration regarding the role of justice system bodies in ensuring the right to judicial protection. Approaches to the formation of the justice system in the context of the social content of public administration are defined, the current state and peculiarities of regulatory and legal provision of public administrative activities in the system of justice bodies, the organizational and legal direction of the modernization of the state mechanism of human rights protection as a direction of public administrative transformations are revealed. On this basis, the directions and perspectives of the introduction of European and national experience in the field of human rights protection into the practice of public administration in Ukraine were improved, and on the basis of this, the directions and institutional forms of the functioning of special mechanisms of public administration in the field of judicial protection of human rights were established, as well as the concept of «organs justice», «judicial authorities» and «judicial authorities» from the standpoint of the concept of human rights protection, the author’s version of such concepts as «public judicial service», «decomposition of the right to judicial protection», developed on the basis of the analysis of the national experience of modernization of public administration, is given.
